| 1.1 | User Agreement | | 1.1.1 | These general auction terms supplement the auction-specific rules applicable to each individual auction. | | 1.2 | Autorola's Liability | | 1.2.1 | Autorola acts solely as the organizer of the Autorola.fi auction and as an intermediary for transactions conducted through the auction. The vehicles auctioned are sold on behalf of and under the responsibility of the respective auction consignor (seller), subject to the exceptions set out in section 1.1.2. | | 1.2.2 | Although Autorola acts only as an intermediary, it serves as the buyer's primary contact and mediator in matters such as disputes related to the ownership of the vehicle being sold. However, Autorola's potential liability for damages shall never exceed the estimated value of the vehicle at the time of repossession or the purchase price paid at auction including fees, regardless of whether the buyer has carried out repairs and/or maintenance on the vehicle. |
| 2.1 | Vehicle | | 2.1.1 | Vehicles are classified according to the seller's classification (sales description). The classification is shown on the relevant auction page together with the damage and/or condition report for the vehicle. | | 2.1.2 | The seller decides which category the vehicle is placed in for sale. Autorola classifies the vehicle based on the information provided by the seller. | | 2.1.3 | If the buyer disputes the classification of a vehicle during the auction, Autorola will make the final decision. The buyer has the right to cancel the transaction if the vehicle has been placed in too high a category. |
| 3.1 | Auction Item | | 3.1.1 | Except for classification, vehicles are sold in the condition they are in at the end of the auction, as described/observed in accordance with section 2.1.1, and without warranty. | | 3.1.2 | The seller provides the vehicle's first registration date and VIN (vehicle identification number). If either is incorrect, the buyer has the right to cancel the transaction (see section 9.1.2). | | 3.1.3 | The buyer must immediately upon delivery or receipt of the vehicle verify that its condition corresponds to the classification and condition report (see section 2.1.1). |
| 4.1 | Auction | | 4.1.1 | The auction list and vehicle catalogue published at the start of the auction are indicative only, and the consignor or Autorola may make changes during the auction. | | 4.1.2 | If, after the auction ends, there is uncertainty as to who made the highest bid, Autorola as the auction organizer will make the final decision based on the time the latest bid was received. This decision is final. | | 4.1.3 | If, in Autorola's or the consignor's opinion, there has been external misuse or technical issues affecting bidding, the consignor may cancel the transaction within 24 hours of sending the electronic sales confirmation to the buyer. | | 4.1.4 | Anyone placing a bid on behalf of another party also assumes liability as a direct guarantor. | | 4.1.5 | If Autorola or the consignor mistakenly auctions the wrong vehicle, the buyer must accept cancellation of the transaction without invoking breach of contract or claiming damages. Autorola will also act as an intermediary between buyer and seller regarding reimbursement of costs incurred by the buyer, such as fuel or transport costs. |
5 | Autorola.fi Bidding Rules |
| 5.1 | Bidding Rules | | 5.1.1 | A bid placed in an Autorola.fi auction cannot be reduced or withdrawn once submitted. | | 5.1.2 | Autorola will resolve any uncertainties related to bids, and its decisions are final and binding on the parties. | | 5.1.3 | Bids are binding on the buyer placing them, who determines the amount they offer in the auction. | | 5.1.4 | If two buyers submit identical bids, the first registered bid is considered the highest. | | 5.1.5 | If a higher bid already exists in the system, a new lower bid will automatically be rejected. | | 5.1.6 | Autorola records and stores all bid-related information in accordance with the Autorola.fi privacy policy. Privacy Policy | | 5.1.7 | When a bid equal to or higher than the seller's reserve price is made, a binding agreement is formed, and both parties are obligated to complete the transaction, subject to the exceptions in sections 4.1.2, 4.1.3, and 4.1.5. |
| 6.1 | Bid Agent | | 6.1.1 | The bid agent is a function that creates an automatic bidder on the server. The buyer may set a maximum bid, and the bid agent will monitor the auction. If another buyer places a higher bid, the bid agent will automatically increase the bid in accordance with the minimum bid increment. This continues until the maximum amount is reached. If multiple bid agents are active, they will increase bids according to the increment rules until one exceeds the others. |
| 7.1 | Purchase Price and Fees | | 7.1.1 | Both buyer and seller pay auction fees to Autorola in accordance with the current price list. For vehicles sold without VAT, applicable VAT will be added. | | 7.1.2 | The full purchase price must be paid according to the rules and instructions provided by the seller in the sales confirmation email. | | 7.1.3 | Ownership of the purchased item transfers to the buyer only once the full purchase price has been paid and receipt of payment has been confirmed by the seller. | | 7.1.4 | The auction fee is payable in all cases where the highest bid has been placed, including cases of erroneous bids. |
| 8.1 | Collection | | 8.1.1 | The buyer must collect the vehicle within the time specified in the auction-specific terms unless otherwise agreed. | | 8.1.2 | If the vehicle is not collected within the specified time, storage fees may be charged from the first day after the collection deadline, according to the applicable auction terms. | | 8.1.3 | Vehicles not collected or not fully paid for within the deadline may be resold without further notice. The buyer is liable for any loss and costs arising from the resale. |
9 | Seller's Liability for Defects |
| 9.1 | Defects and Deficiencies | | 9.1.1 | The buyer may cancel the transaction only in the following cases:
a) The vehicle has been placed in too high a category, provided it is returned immediately and without delay after receipt and has not been registered by the buyer.
b) The VIN does not match the vehicle documents, or the provided information does not match the documents or actual facts, if this discrepancy is materially significant to the buyer. The same applies if official annotations affecting the vehicle exist in the documents but were not disclosed in the auction.
c) There are uncertainties regarding ownership, such as third-party rights or theft, and only if these uncertainties cannot be resolved within reasonable time.
d) The stated mileage or first registration date deviates significantly from the actual figures. |
| 10.1 | Claims | | 10.1.1 | All claims must be made in accordance with the auction-specific rules. | | 10.1.2 | No repair work may be initiated on a vehicle subject to a claim before it has been re-inspected. Repairs started before re-inspection will not be compensated if the transaction is later cancelled. | | 10.1.3 | No claim can be made after the vehicle has been registered. | | 10.1.4 | No claim can be made for vehicles where the bid price (excluding fees and VAT) is EUR 1,500 or less. | | 10.1.5 | Costs related to retrieving a vehicle due to a claim will not be reimbursed. | | 10.1.6 | Claims regarding missing accessories or non-fixed equipment cannot be made after collection of the vehicle. Such items include, for example, extra sets of tires, locking bolts, mats, non-fixed navigation devices, memory cards, and roof racks. These must be checked by the buyer or their representative at the time of collection. |
